Jones's Agreement expires on December 31, 2024; and WHEREAS, in accordance with C.R.S. 13-10-105 the municipal judge may be appointed by the governing body for a specified term of not less than two years and may be reappointed for a subsequent term; and WHEREAS the Board of Trustees desires to re -appoint Judge Stevens for an additional two-year term, commencing January 1, 2025, through December 31, 2026. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO: Section II Term of the Presiding Municipal Court Judge Agreement is approved in substantially the same form as the copy attached hereto and made a part of the Amended Agreement and the Mayor is authorized to execute the Amended Agreement on behalf of the Town. Hayashi, T Attorney THIS AGREEMENT is made and entered into on January 26, 2022, by and between the Town of Firestone, a Colorado statutory municipality ('"Town"), and Stephen A. Jones ('"Judge Jones"). WHEREAS, pursuant to Section 2.44.00 of the Town of Firestone Municipal Code ("Code") the Town's Board of Trustees shall appoint a Presiding Municipal Court Judge; and WHEREAS, pursuant to C.R.S. 13-10-107 the salary for the Judge shall be a fixed annual compensation and payable on a monthly or other periodic basis as set forth by ordinance; and WHEREAS, on January 12, 2022, the Board of Trustees, by motion, appointed Stephen A. Jones as the Presiding Municipal Court Judge of the Town of Firestone; and WHEREAS, the Board of Trustees and Mr. Jones desires to memorialize the terms of his appointment as Presiding Municipal Court Judge. NOW, THEREFORE, for and in consideration of the promises and covenants herein, the parties agree as follows: Judge Stephen A. Jones as the Town of Firestone's Presiding Municipal Court Judge has all judicial powers set forth in Section 2.44.030 of the Firestone Municipal Code, C.R.S. Article 10 Chapter 13 and as set forth in the Colorado Municipal Court Rules of Procedure, Court Rules Chapter 30. IIIll1I Judge Jones shall be re -appointed for a term commencing January 1, 2025, through December 31, 2026. The fixed annual compensation for Judge Jones as Presiding Municipal Court Judge shall be $18,000, per annum payable monthly in the amount of $1,500.00. The Board shall also reimburse Judge Jones for judicial professional memberships and training in an amount not to exceed $2,000 per annum. IYI1 III LE$A,A,U1 Judge Jones job performance, salary, and other contractual issues, if any, shall be reviewed by the Board of Trustees on an annual basis or as otherwise requested by either party. In addition, Judge Jones will present to the Town Board annually to provide an update to the Town's Board of Trustees regarding the operation of the municipal court. Page 1 oft This Agreement may be executed in any number of counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument. The parties agree that signatures transmitted by facsimile or electronically shall be binding as if they were original signatures. IN WITNESS WHEREOF, the parties have executed this Agreement.
