HomeMy WebLinkAbout24-121 Approving an Amended Agreement with the Town and Stephen A Jones for Local Liquor License Authority Services 12-18-2024aWI ii I UdI DII • I WHEREAS, pursuant to Section 5.08.090 of the Firestone Municipal Code the Town of Firestone's Local Liquor License Authority shall consist of a Hearing Officer appointed by the Board of Trustees; and WHEREAS the Board of Trustees upon finding that the Municipal Court Judge, Stephen A. Jones had the qualifications, experience expertise and desire to serve as the Hearing Officer appointed Judge Jones to serve as the Hearing Officer concurrent with his term as Municipal Court Judge; and WHEREAS though Judge Jones term as Municipal Court Judge will expire on December 31, 2024, the Board of Trustees has extended his term for the period of January 1, 2025 through December 31, 2026; and WHEREAS the parties also desire to have Judge Jones continue his services as the Local Liquor License Authority Hearing Officer for an additional two-year term, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO: Section II Term of the Agreement between the Town of Firestone and Stephen A, Jones for Local Liquor License Authority Hearing Officer services is approved in substantially the same form as the copy attached hereto and made a part of this resolution, and the Mayor is authorized to execute the Amended Agreement on behalf of the Town. INTRODUCED, READ AND ADOPTED this 18th day of December, 2024. TOWN OF EIIESTONECOLORADO AMENDED AGREEMENT - LOCAL LIQUOR LICENSE AUTHORITY HEARING OFFICER THIS AGREEMENT is made and entered into on March 9, 2022, by and between the Town of Firestone, a Colorado statutory municipality ("Town"), and Stephen A. Jones. RECITALS WHEREAS, pursuant to Section 5.08.090 of the Town of Firestone Municipal Code ("Code") the Town of Firestone's Local Liquor License Authority shall consist of a Hearing Officer appointed by the Board of Trustees; and WHEREAS, the Board of Trustees finds that the Municipal Court Judge, Stephen A. Jones ("Jones") has the qualifications, experience, expertise and desire to serve as the Hearing Officer; and WHEREAS, the Board of Trustees desires to appoint Judge Jones as the Hearing Officer and memorialize the terms of his appointment. NOW, THEREFORE, for and in consideration of the promises and covenants herein, the parties agree as follows: I. AUTHORITY Stephen A. Jones is hereby appointed to serve as the Hearing Officer for the Local Liquor License Authority ("Authority") and exercise the duties of the Authority as set forth in the Colorado Liquor Code Article 3, Title 44 C.R.S. II. TERM Jones shall serve for a term concurrent with his appointment as Municipal Court Judge which terminates on December 31, 2026. III. SCHEDULE AND COMPENSATION Jones shall not charge a fee for uncontested matters which will be held in the Municipal Court and scheduled concurrently with regular court dates Jones shall be compensated at the rate of $75.00 per hour for any contested matter, which shall be held in the Municipal Court and scheduled at the convenience of the parties. IV. OTHER COVENANTS Judge Jones job performance, salary, and other contractual issues, if any, may be reviewed by the Board of Trustees on an annual basis or as otherwise requested by either party. V. COUNTERPARTS Page 1 of 2 This Agreement may be executed in any number of counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument. The parties agree that signatures transmitted by facsimile or electronically shall be binding as if they were original signatures. IN WITNESS WHEREOF, the parties have executed this Agreement.
