HomeMy WebLinkAbout 14-09 Approving a Mail Ballot ElectionRESOLUTION NO. 14-09 A RESOLUTION REPEALING RESOLUTION NO. 13-50 AND AUTHORIZING A MAIL BALLOT ELECTION TO BE HELD IN ACCORDANCE WITH THE COLORADO MUNICIPAL ELECTION CODE FOR THE TOWN OF FIRESTONE REGULAR MUNICIPAL ELECTION ON APRIL 1, 2014 WHEREAS, the Town will conduct its regular municipal election on April 19 2014; and WHEREAS, on November 13, 2013, the Board of Trustees adopted Resolution No. 13-50 authorizing a mail ballot election to be held in accordance with the requirements and procedures of the Uniform Election Code of 1992, articles 1 to 13 of title 1, C.R.S., in lieu of the Colorado Municipal Election Code of 1965, article 10 of title 31, C.R.S.; and WHEREAS, on February 18, 2014, the Governor signed into law H.B 14-1164, which among other things, amended the Colorado Municipal Election Code to include specific mail ballot election procedures for municipal elections that are not coordinated by the County Clerk and Recorder; and WHEREAS, the Board of Trustees finds it in the best interests of the Town of Firestone to conduct its regular municipal election on April 1, 2014 as a mail ballot election in accordance with the new procedures set forth in the Colorado Municipal Election Code; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO: Section 1. Resolution No. 13-50, concerning the utilization of the Uniform Election Code with respect to the Town's April 1, 2014 regular municipal election, is hereby repealed in its entirety. Section 2. The Town of Firestone regular municipal election to be held on April 1, 2014 shall be conducted as a mail ballot election in accordance with the requirements and procedures of the Colorado Municipal Election Code of 1965, article 10 of title 31, C.R.S., as amended. Section 2. The Town Clerk is hereby directed to take all such steps as are necessary to conduct the April 1, 2014 election as a mail ballot election pursuant to the Colorado Municipal Election Code.
