AN ORDINANCE OF THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO,
AMENDING SECTION 10.04.010 ADOPTION OF THE 2024 MODEL TRAFFIC CODE FOR COLORADO
WHEREAS, the Town of Firestone ("Town") by Ordinance No. 1055 adopted the 2024 Model Traffic Code with
amendments; and
WHEREAS, the Colorado Department of Transportation and Office of the Attorney General are requiring that all
municipalities expressly state in the adoption of the Model Traffic Code that the Town's amendments to the Model Traffic
Code do not apply to state highways.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE,
COLORADO:
Section 1 Adoption Section 10.04.010 of the Model Traffic Code is amended to read as follows:
Sec. 10.04.010. - Adoption.
The 2024 Model Traffic Code for Colorado, promulgated and published by the Colorado Department of
Transportation, Traffic Safety and Engineering Services, 2829 West Howard Place, Denver, Colorado, 80204, including
the Definitions in the Appendices but excluding Appendices A, B, C, D, E, F & G, Part 17, Penalties and Procedure, and
Part 18 Vehicles Abandoned on Public Property in their entirety, is hereby adopted by reference as the Model Traffic
Code for the Town of Firestone as if fully set out in this ordinance however, the amendments set forth in this chapter shall
not apply to any state highway within the Town.
Section 2. If any article, section, paragraph, sentence, clause, or phrase of this ordinance is held to be
unconstitutional or invalid for any reason, such decision shall not affect the validity or constitutionality of the remaining
portions of this ordinance. The Board of Trustees hereby declare it would have passed this ordinance and each part or
parts hereof irrespective of the fact that any one part or parts be declared unconstitutional or invalid.
Section 3. Violations of this ordinance shall be punishable in accordance with Section 1.16.010 of the
Municipal Code of the Town of Firestone, Colorado.
Section 4. All other ordinances or portions thereof inconsistent or conflicting with this ordinance or any
portion hereof are hereby repealed to the extent of such inconsistency or conflict.
