Shadows F 2, Replat 1RESOLUTION NO. 14-� A RESOLUTION APPROVING A FINAL SUBDIVISION PLAT AND FINAL DEVELOPMENT PLAN FOR THE MOUNTAIN SHADOWS SUBDIVISION, FILING 2, REPLAT NO, 1 WHEREAS, there has been submitted to the Board of Trustees of the Town of Firestone a request for approval of a Final Subdivision Plat and Final Development Plan for Filing 2, Replat No. 1 of the Mountain Shadows subdivision; and WHEREAS, all materials related to the application have been reviewed by Town Staff and the Firestone Planning and Zoning Commission and found with conditions to be in compliance with Town of Firestone subdivision and zoning ordinances, Development Regulations, and related Town ordinances, regulations, and policies; and WHEREAS, the Firestone Planning and Zoning Commission has held a properly noticed public hearing on the application, and has forwarded to the Board of Trustees a recommendation of approval with conditions; and WHEREAS, the Board of Trustees has duly considered the proposed final subdivision plat and final development plan and has held a properly noticed public hearing on the application; and WHEREAS, the Board of Trustees finds the proposed final subdivision plat and development plan to be in compliance with Town of Firestone subdivision and zoning ordinances, Development Regulations, and related Town ordinances, regulations, and policies and should therefore be approved, subject to certain conditions; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO0 Section 1. The Board of Trustees of the Town of Firestone does hereby approve the proposed Final Subdivision Plat and Final Development Plan for Filing 2, Replat No. 1 of the Mountain Shadows subdivision, subject to the conditions set forth on Exhibit A, attached hereto and incorporated herein by reference. PASSED AND ADOPTED this 25t" day of June, 2014. �\vESTo ATTEST: Town Clerk Mayor EXHIBIT A Final Subdivision at &Final Development an Mountain Shadows Filing 2, Replat No. 1 Conditions of Approval 1. Modify plat and FDP to address comments in Town Engineer's redlines and memorandum dated June 17, 2014. 2. Revise the fencing details and add a note confirming that the fencing shall be consistent with Filing 1 fencing. 3. Add a note to the fencing that states corner lot side yard fencing shall be consistent with the Town Code, 4. Modify plat and FDP to address Town Planner redlines. 5. A Subdivision Agreement for Mountain Shadows Subdivision Filing No. 2, Replat No. 1 shall be executed in a form approved by the Town Attorney to include Replat No. 2. The Agreement shall require the Subdivider dedicate the additional raw water required for Replat No. 1 (an additional 12 CBT shares) and for Replat No. 2 (an additional one CBT Share for the additional lot). The additional raw water dedication requirements shall be satisfied prior to recording of the replat plats, and shall be satisfied by payment of cash- m lieu at the rate of $22,000 per Share. Revise FDP Plan sheets to reflect this water dedication requirement.
