A RESOLUTION APPROVING A FINAL PLAT FOR CIMARRON POINTE, FIRST FILING
AND AN AMENDED FINAL DEVELOPMENT PLAN FOR CIMARRON POINTE
WHEREAS, there has been submitted to the Board of Trustees of the Town %J Firestone a
request for approval of a final plat and an amended overall final development plan for Cimarron
Pointe, First Filing; and
WHEREAS, all materials related to the proposed final plat and amended final development
plan have been reviewed by Town Staff and the Firestone Board of Trustees and found with
conditions to be in compliance with Town of Firestone subdivision and zoning ordinances,
Development Regulations, and related Town ordinances, regulations, and policies; and
WHEREAS, the Firestone Planning and Zoning Commission has held a properly noticed
public hearing on the application, and has forwarded to the Board of Trustees its recommendation;
and
WHEREAS, the Board of Trustees has duly considered the proposed final plat and amended
Final development plan and the recommendation of the Planning and Zoning Commission, and has
held a properly noticed public hearing on the application; and
WHEREAS, the Board of Trustees finds that the proposed final plat and amended final
development plan should be approved subject to certain conditions.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE
TOWN OF FIRESTONE, COLORADO:
Section 1. The Board of Trustees of the Town of Firestone does hereby approve the
proposed final plat for Cimarron Pointe, First Filing and the amended final development plan for
Cimarron Pointe, subject to the conditions set forth on Exhibit A attached hereto and incorporated
herein by reference.

Conditions of Approval
General
1. Address Town Engineer comments and redlines dated July 3, 2014 and August 0
2. Address Town Planner comments dated August 6, 2014.
3. Execute an Assignment and Amendment to the Subdivision Agreement prepared by the
Town Attorney.
4. Provide an updated title commitment dated no later than one month prior to recording of
Plat

Add a notary block for the Lender's Consent.
Add the following note to the plat:
Outlot I was previously divided by foreclosure of a deed of trust pursuant to
Public Trustee's Foreclosure Sale No. 11-0387, as set forth in that Confirmation
Deed issued on August 1, 2011 by the Public Trustee in and for the County of
Weld State of Colorado, which Deed was recorded with the Weld County Clerk
and Recorder on August 2, 2011 with Doc Id 3783723. Pursuant to Section
16.04.040.13.3 of the Firestone Municipal Code, such division was not subject to
the subdivision regulations of the Town of Firestone, and was therefore not
accomplished by a recorded subdivision plat
7. On the site plan, label all building setbacks from property lines and between structures.
8. Provide a Controls section pursuant to the Firestone Development Regulations.
9. Modify text in the water dedication pursuant to comments from the Town Engineer.
10. Provide an Architectural section pursuant to the Firestone Development Regulations.
11. Add a note in the Development Schedule/Phasing section that this FDP expires if
construction of development does not commence by September 1, 2017.
12. Provide information regarding the colors of the trash enclosure.
13. Correct references to "PDP" in the Site Pan Notes section to read "FDP"
14. Remove notes regarding the retaining wall and identify the height, materials, colors, etc.
15. Confirm there in not a conflict with trees or shrubs over easements.
16. Provide additional bluegrass and 5-gallon shrubs on the landscape plan sheet, as
described at the public hearing.
17. Update the plant list on the landscape plan sheet.
18. Confirm the streetlight detail is consistent with the completed portion of Phase 1
(condominiums).
