RESOLUTION NO. —
A RESOLUTION OF THE TOWN OF FIRESTONE, COLORADO, REGARDING
THE PROVISION OF EMERGENCY SERVICES TO AN ANNEXATION OF THE
TOWN OF FIRESTONE
WHEREAS, by Ordinance number 826, the Town of Firestone ("Town") annexed
property known as the McMurray Annexation ("McMurray Annexation") within its corporate
b6undaries. The McMurray Annexation was recorded on October 4, 2013, and became effective
as of that date. The legal description for the McMurray Annexation is attached as Exhibit As and
WHEREAS, the Town and the Frederick -Firestone Fire Protection District Firestone FPD") FPD") entered into an intergovernmental agreement ("IGA") on October 30, 2003,
which obligates Frederick -Firestone FPD to provide, and designates Frederick -Firestone FPD as
the sole provider of, fire prevention, fire suppression, emergency medical, emergency rescue,
ambulance, and hazardous materials services (collectively, "Emergency Services") to all property
within the Town's corporate boundaries. On July 25, 2012, the Town renewed the IGA for a ten-
year term to expire October 30, 2023; and
WHEREAS, the McMurray Annexation is currently located within the boundaries of the
Mountain View Fire Protection District ("Mountain View FPD"), which currently provides the
Emergency Services to the McMurray Annexation; and
WHEREAS, the Town, through the IGA with Frederick -Firestone FPD, can provide the
same or better fire protection and Emergency Services to the McMurray Annexation as Mountain
View FPD currently provides; and
WHEREAS, the Town Board of Trustees believes it is in the best interests of the
McMurray Annexation, and the Town's citizens and their property, for the Town, through the
IGA with Frederick -Firestone FPD, to provide the Emergency Services to the McMurray
Annexation immediately upon exclusion of the McMurray Annexation from Mountain View
FPD.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF
THE TOWN OF FIRESTONE, WELD COUNTY, COLORADO, THAT:
Section 1. The Town, through the IGA with Frederick -Firestone FPD, will provide
the Emergency Services to the McMurray Annexation on and after the effective date of the Court
Order excluding the McMurray Annexation from Mountain View FPD.
Section 2. Effective Date. This resolution shall be become effective immediately
upon adoption.
Section 3. Repealer. All resolutions or parts thereof, in conflict with this resolution
are hereby repealed, provided that such repealer shall not repeal the repealer clauses of such
resolution nor revive any resolution thereby.
Section 4. Certification, The Town Clerk shall certify to the passage of this
resolution and make not less than one copy of the adopted resolution available for inspection by
the public during regular business hours.

A tract of land located in the El/2 of the NEl/4 of Section 10, T2N, R68W of the 6th P.M.,
County of Weld, State of Colorado, being more particularly described as follows:
COMMENCING at the Northeast Corner of said Section 10 from which the Nl/4 Corner of said
Section 10, bears N89°50'51 "W, 2641.06 feet (Basis of Bearing), thence N89°50'51 "W, 450.00
feet along the North Line of said NEIA of Section 10; thence S00°28'41 "W, 1967.50 feet along
a Line which is 450.00 feet Westerly of and Parallel with the East Line of said NE1/4 of Section
10;
to the POINT OF BEGINNING;
Thence continuing S00°28'41 "W, 217.80 feet along said Parallel Line;
Thence S89°50'S1 "E, 399.89 feet along a Line which is Parallel with said North Line of the
