Home My WebLink About 14-63 Regarding Provision of Emergency Services to Highway 119 AnnexationTOWN OF FIRESTONE, COLORADO RESOLUTION NO, A RESOLUTION OF THE TOWN OF FIRESTONE, COLORADO, REGARDING THE PROVISION OF EMERGENCY SERVICES TO AN ANNEXATION OF THE TOWN OF FIRESTONE WHEREAS, by Ordinance numbers 672 and 787, respectively, the Town of Firestone ("Town") annexed properties known as the Firelight Park Annexation ("Firelight Park Annexation") and Turner Commons Annexation ("Turner Commons Annexation"), within its corporate boundaries. The Firelight Park Annexation was recorded on August 13, 2009, and became effective as of that date. The Turner Commons Annexation was recorded on March 26, 2012, and became effective as of that date; and WHEREAS, the Firelight Park Annexation and Turner Commons Annexation, collectively, included a parcel of right -of --way property along State Highway 119 ("Highway 119 Property"), which also was annexed to the Town as part of the Firelight Park Annexation and Turner Commons Annexation. The legal description for the Highway 119 Property is attached as Exhibit A; and WHEREAS, the Town and the Frederick -Firestone Fire Protection District ("Frederick - Firestone FPD") entered into an intergovernmental agreement ("IGA") on October 30, 2003, which obligates Frederick -Firestone FPD to provide, and designates Frederick -Firestone FPD as the sole provider of, fire prevention, fire suppression, emergency medical, emergency rescue, ambulance, and hazardous materials services (collectively, "Emergency Services") to all property within the Town's corporate boundaries. On July 25, 2012, the Town renewed the IGA for a ten- year term to expire October 30, 2023; and WHEREAS, the Highway 119 Property is currently located within the boundaries of the Mountain View Fire Protection District ("Mountain View FPD"), which currently provides the Emergency Services to the Highway 119 Property; and WHEREAS, the Town, through the IGA with Frederick -Firestone FPD, can provide the same or better fire protection and Emergency Services to the Highway 119 Property as Mountain View FPD currently provides; and WHEREAS, the Town Board of Trustees believes it is in the best interests of the Highway 119 Property, and the Town's citizens and their property, for the Town, through the IGA with Frederick -Firestone FPD, to provide the Emergency Services to the Highway 119 Property immediately upon exclusion of the Highway 119 Property from Mountain View FPD. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, WELD COUNTY, COLORADO, THAT: Section 1. The Town, through the IGA with Frederick -Firestone FPD, will provide the Emergency Services to the Highway 119 Property on and after the effective date of the Court Order excluding the Highway 119 Property from Mountain View FPD. Section 2. Effective Date. This resolution shall be become effective immediately upon adoption. -1- 2049601.1 Section 3. Repealer. All resolutions or parts thereof, in conflict with this resolution are hereby repealed, provided that such repealer shall not repeal the repealer clauses of such resolution nor revive any resolution thereby. Section 4. Certification, The Town Clerk shall certify to the passage of this resolution and make not less than one copy of the adopted resolution available for inspection by the public during regular business hours.
