That the Board of Trustees, as the governing body of the Town of Firestone, Colorado, does hereby determine, based on representations by and on behalf of The Greens Metropolitan District formerly known as the Firestone Trails Metropolitan District (the "District"), that all of the requirements of Title 32, Article 1, Part 2, C.R.S., as amended, relating to the filing of an amendment to the service plan for the District have been fulfilled and that notice of the hearing was given in the time and manner required by the Town; Section 2. That, based on representations by and on behalf of the District, the Board of Trustees of the Town of Firestone, Colorado, has jurisdiction over the subject matter of the First Amendment pursuant to Title 32, Article 1, part 2, C.R.S., as amended; Section 3. That, pursuant to § 324-204.5, C.R.S., § 324-202(2)9 C.R.S., § 32- 1-203(2) and § 32-1-207(2), C.R.S., the Board of Trustees of the Town of Firestone, Colorado, does hereby find and determine, based on the First Amendment and other evidence presented by and on behalf of the District, that: (a) The First Amendment to confirm the District Court approval of the change of the name of the District to "The Greens Metropolitan District" will be in the best interests of the area proposed to be served. Section 4. That the First Amendment, as set forth in Exhibit A to this Resolution and with a submittal date of January 11, 2013, has been made and is hereby approved by the Town in accordance with § 324-204 5(1)(c), C.R.S. The District's current boundaries consist of approximately one hundred forty-five (145) acres and are generally located between the intersections of Pine Cone Avenue and Colorado Boulevard and Pine Cone Avenue and Frontier Street, entirely within the boundaries of the Town.
