HomeMy WebLinkAbout25-74 Calling for a Town Election on November 4, 2025 through Weld County 07-09-2025WHEREAS, the Town Board interprets C.R.S., § 31-10-109(l)(a) to mean that if a
majority of the voters approve the question of whether the Town's regular election date should be
changed, then the voters must have implicitly approved a corresponding extension of the terms of
each elected or appointed member of the Town Board in office at the time of its approval to
accomplish the change in election dates in an orderly manner; and
WHEREAS, the Town Board. further interprets C.R.S., § 31-10-109(l)(a) and (l)(b),
working in tandem with one another, to mean that to effectuate the will of the electors voting in
favor of a change in election dates, then by operation of law the Town Board must establish the
new regular election date by ordinance and include in that ordinance a provision extending the
terms of each currently elected or appointed member of the Board of i::rustees such that the term
shall expire in November rather than in April of the year in which the term expires; and
WHEREAS, in order to promote efficiency, voter participation and to reduce Town
election costs, in accordance with Sections 31-101-109 and 31-11-111(2), C.R.S., the Town Board
of Trustees desires to submit to a vote of the registered electors of the Town a ballot question to
determine whether the regular election date of the Town should be changed to the Tuesday
succeeding the first Monday in November of each even numbered year.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF
THE TOWN OF FIRESTONE, COLORADO:
Section 1. Election Call. Pursuant to C.R.S. §31-10-109(l)(a), the Town Board calls
for a special election to be held on November 4, 2025, for the purposes set forth in this Resolution,
which is also a designated coordinated election date. The November 4, 2025 Town special election
shall be conducted as a mail ballot election, coordinated with Weld County, Colorado, in
accordance with the Colorado Mail Ballot Election Act, C.R.S §§ 1-7.5-101 et seq, and all other
applicab le provisions of the Uniform Election Code.
Section 2. Question Submitted. In accordance with Sections 31-10-109 and 31-11-
111 (2), C.R.S., the Board of Trustees hereby submits the following ballot question to the eligible
electors of the Town:
SHALL THE TOWN OF FIRESTONE'S REGULAR ELECTION DATE BE MOVED
FROM THE FIRST TUESDAY IN APRIL OF EACH EVEN-NUMBERED YEAR TO
THE TUESDAY ON WHICH THE GENERAL STATEWIDE ELECTION IS HELD IN
NOVEMBER OF EACH EVEN NUMBERED YEAR TO INCREASE VOTER
PARTICIPATION, TO ALLOW THE TOWN TO SAVE ELECTION COSTS AND TO
PARTICIPATE IN ELECTIONS COORDINATED BY THE COUNTY?

Section 3. Ballot Title Fixed. This Resolution shall serve to set the content for the
ballot question set forth herein and the ballot title for such question shall be the text of the question
itself
