HomeMy WebLinkAboutBoard of Trustees Action Items - October 25 - 10/27/2023Board of Trustees Action Items Wednesday, October 25, 2023 WCR 9.5 Annexation Approved In two separate actions aer a Public Hearing during Wednesday night's meeting, the Board of Trustees accepted certain findings of fact in favor of the WCR 9.5 Annexation by approving Resolution 23-113, and annexed that portion of WCR 9.5 by approving Ordinance 1034. On September 5, 2023, the Town of Mead submitted a Petition for Annexation to the Town of Firestone for a 3.53-acre portion of WCR 9.5, from CR 28 south to the existing boundary between the Towns of Firestone and Mead. The Board of Trustees previously approved an Intergovernmental Agreement (IGA) with the Town of Mead on January 14, 2015, which assigned maintenance responsibility for this right-of-way to the Town of Firestone. It was later determined that the best way to proceed was for the right-of-way to be disconnected from the Town of Mead and annexed into the Town of Firestone. CDOT Mobility Hub Annexation & Zoning Approved In three separate actions aer a Public Hearing, the Board of Trustees accepted certain findings of fact in favor of the CDOT Mobility Hub Annexation by approving Resolution 23-114, annexed the CDOT Mobility Hub property by approving Ordinance 1035, and approved the initial zoning of Regional Commercial (RC) of the CDOT Mobility Hub with the approval of Ordinance 1036 during Wednesday night's meeting. The area annexed and zoned is owned by the Colorado Department of Transportation (CDOT), who submitted a petition for annexation and proposed zoning for 5.416 acres of unincorporated Weld County into the Town of Firestone. The property is located at the southeast corner of Highway 119 (Firestone Boulevard) and I-25. Learn more about CDOT's Mobility Hub project here. Cooperative Development Plan Agreement Approved with Kerr-McGee During Wednesday night's meeting, the Board of Trustees approved Resolution 23-115, authorizing the execution of a Cooperative Development Plan Agreement with Kerr-McGee Oil & Gas Onshore. In April of 2021, a similar agreement was approved by the Board of Trustees, but that drilling plan was ultimately denied by the State of Colorado Oil & Gas Conservation Commission. Subsequent to that denial Kerr-McGee prepared a revised drilling plan which contemplates three separate locations outside, but in close proximity to, Firestone. In exchange for Firestone's willingness to grant right-of-way access permits and enter into certain license agreements, the company has agreed to make a land donation of 78 acres to the Town of Firestone and provide a one-time cash payment of $4 million. In addition, the agreement also includes certain operational standards to mitigate impacts, and includes the commitment of the plugging and abandonment of 57 wells within the Town of Firestone boundaries. Final Review of the 2024 Budget The Board of Trustees began reviewing the 2024 proposed budget in a Work Session on Wednesday, September 20, 2023. In subsequent meetings, all funds have been presented and discussed with the Finance Committee and the Board of Trustees, and all documents presented throughout the budget preparation process have been posted at www.firestoneco.gov/budget. During Wednesday night's meeting, the Board of Trustees had a final review of the proposed 2024 budget. If needed, the Board of Trustees can review again and ask any remaining questions during the November 8, 2023 meeting. A Public Hearing has been scheduled for Wednesday, November 15, 2023, to adopt the 2024 budget.
