HomeMy WebLinkAbout999 Amending Chapter 12.32 - Park and Recreation Facilities 07-28-2021ORDINANCE NO. 999 AN ORDINANCE OF THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO, AMENDING CHAPTER 12.32 — PARK AND RECREATION FACILITIES WHEREAS, Section 12.32.060 Regulations; prohibited acts, of the Firestone Municipal Code authorizes persons upon the prior approval of the Director (includes Director of Public Works) to conduct business, commercial activities, or sales for profit in any park or recreation facility subject to certain terms and conditions; and WHEREAS, to approve such uses the Director must develop administrative regulations and forms and review such requests to determine if the requested use is appropriate; and WHEREAS, commercial use of the Town's parks will impose additional costs upon the Town including for example, the modification of maintenance and irrigation schedules, users consumption of electricity and need for additional trash service along with associated administrative duties; and WHEREAS, to ensure that the Town recovers its costs for the commercial use of the Town's parks and recreation facilities the Public Works Director recommends that the Town enact a Park Use fee. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO: Section 1. Section 12.32.060 A, Regulations; prohibited acts is amended to provide as follows: A. Conduct business, commercial activities or sales for profit in any parks or recreation facilities (such as, by way of example and not limitation, races or events; filming movies or commercials; or equipment demonstrations) upon prior approval of the Director and payment of a monthly Park Use Fee in an amount determined by resolution of the Board of Trustees. Request Form by the Director. Individuals engaging in still camera photography are exempt from this prohibition. Section 2. If any article, section, paragraph, sentence, clause, or phrase of this ordinance is held to be unconstitutional or invalid for any reason, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The Board of Trustees hereby declare it would have passed this ordinance and each part or parts hereof irrespective of the fact that any one part or parts be declared unconstitutional or invalid. Section 3. Violations of this ordinance shall be punishable in accordance with Section 1.16.010 of the Municipal Code of the Town of Firestone, Colorado. Section 4. All other ordinances or portions thereof inconsistent or conflicting with this ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or 1 conflict.
