AN ORDINANCE OF THE BOARD OF TRUSTEES OF THE TOWN OF
FIRESTONE, COLORADO APPROVING INITIAL ZONING OF CERTAIN
LAND, FULLY DESCRIBED HEREIN, TO TOWN OF FIRESTONE PLI —
PUBLIC LANDS AND INSTITUTIONS ZONING DISTRICT
WHEREAS, a petition for annexation ("Petition") of certain unincorporated property known as
the Firestone County Road 19 Annexation No's. 1 through 8 was filed with the Board of Trustees of the
Town of Firestone requesting the annexation of certain property commonly known as Firestone County
Road 19 Annexation Nos. 1 through 8, as more particularly described in the Petition, and which property
is described with particularity in Exhibit A attached hereto and incorporated herein by reference (the
"Property"); and
WHEREAS, the property was annexed to the Town by Ordinance No. 996 ("Annexation
Ordinance"); and
WHEREAS, as required by C.R.S. § 31-12-115(2) and in conformance with Section 17.7.4(D)
of the Firestone Development Code, property annexed to the Town must be zoned pursuant to the Town's
zoning regulations within ninety (90) days after the effective date of the Annexation Ordinance; and
WHEREAS, on July 14, 2021, the Board of Trustees conducted a public hearing to consider initial
zoning of the property; and
WHEREAS, after considering the testimony, evidence and argument presented at the public
hearing, the Board of Trustees finds and determines that the application is complete and meets the applicable
requirements and standards set forth in Section 16.7.4 of the Firestone Development Code, including the
criteria of approval set forth in Step 9 of Section 16.7.4(E),
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
TOWN OF FIRESTONE, COLORADO:
Section 1. The foregoing recitals are hereby incorporated as findings of the Board of
Trustees, and the Property described in Exhibit A, which consists of a total of 36.785 acres, more or less,
shall be zoned from Weld County A -Agricultural Zoning District to Town of Firestone PLI (Public Lands
and Institutions) Zoning District.
Section 2. The Board of Trustees certifies a change in the Zoning Map consistent with this
Ordinance to reflect initial zoning of the Property described herein to Town of Firestone PLI (Public
Lands and Institutions) Zoning District.
Section 3. The Board of Trustees directs that a certified copy of this Ordinance be filed with
the Town Clerk and further, that the Town Clerlc index, file and make the Ordinance available to the
public.
Section 4. If any article, section, paragraph, sentence, clause or phrase of this ordinance is
held to be unconstitutional or invalid for any reason, such decision will not affect the validity or
constitutionality of the remaining portions of this ordinance. The Board of Trustees hereby declares that
it would have passed this ordinance and each part or parts hereof irrespective of the fact that any one
part or parts be declared unconstitutional or invalid.
Section 5. All other ordinances or portions thereof inconsistent or conflicting with this
ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict.
