HomeMy WebLinkAbout996 Annexing County Road 19 Nos 1 through 8 & Approving Annexation Agreement 07-14-2021ORDINANCE N0.996 AN ORDINANCE OF THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO ANNEXING THE PROPERTY KNOWN AS FIRESTONE COUNTY ROAD 19 ANNEXATION NOS, 1 THROUGH 8 TO THE TOWN OF FIRESTONE, COLORADO AND APPROVING AN ANNEXATION AGREEMENT WITH THE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY WHEREAS, the Board of Trustees previously adopted Resolution 21-63, finding substantial compliance and initiating annexation proceedings for the Firestone County Road 19 Annexation Nos. 1 through 8, as described therein and as described below; and WHEREAS, the Board of Trustees held a duly noticed public hearing to consider annexation of the Property, notice of which was duly published in accordance with the requirements set forth in Section 3142-108(2), C.R.S.; and WHEREAS, following said hearing, the Board adopted Resolution 21-84, setting forth findings of fact and determinations regarding the eligibility of the Firestone County Road 19 Annexation Nos. 1 through 8; and WHEREAS, the Board of Trustees has determined that it is in the best interests of the Town of Firestone to annex the property to be known as the Firestone County Road 19 Annexation Nos. 1 through 8 (the "Property") to the Town; and WHEREAS, in accordance with Section 1.08.040 of the Firestone Municipal Code, the Board and the Weld County Board of County Commissioners have agreed upon the terms of an annexation agreement. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO: Section 1. The Board of Trustees makes and adopts the determinations and findings contained in the recitals set forth above. Section 2. The Board of Trustees hereby incorporates the findings of Resolution 21-63 and Resolution 21-84; the Board of Trustees further finds that the annexation of the Property is in compliance with the Municipal Annexation Act of 1965 and that it is in the best interests of the Town to annex the Property to the Town. Section 3. The Property, as more particularly described in Exhibit A attached hereto, is hereby annexed to the Town and included within the corporate limits of the Town, in series and in the sequence as set forth in Exhibit A, to be known as the Firestone County Road 19 Annexation Nos. 1 through 8, which annexation shall become effective upon completion of the conditions contained in C.R.S. § 3142413, including, without limitation, all required filings for recording with the Weld County Clerk and Recorder as further set forth in Section 4 of this Ordinance. Section 4. The Board of Trustees hereby directs Town staff to complete all necessary procedures required for annexation of the Property to the Town including filing for record with the Weld County Clerk and Recorder the following documents: (1) three certified copies of this Annexation Ordinance, (2) the map of the annexed Property containing a legal description of the Property annexed hereby ("Annexation Map"); and (3) the Annexation Agreement; and further, directs Town staff to file the original of this Annexation Ordinance together with a copy of the Annexation Map with the Town Clerk of the Town of Firestone. Section 5. That in annexing the Property to the Town, the Town does not assume any obligation regarding the construction of water mains, sewer lines, gas mains, electrical service lines, streets or any other service or utilities in connection with the Property hereby annexed, except as may be provided by ordinances of the Town or pursuant to agreement between the Town and the Weld County Board of County Commissioners, Section 6. The Board of Trustees, having considered the annexation agreement attached hereto as Exhibit B ("Annexation Agreement"), hereby approves the Annexation Agreement and authorizes the Mayor to execute the same.
