VRAIN WATER TREATMENT PLANT AGREEMENT WHEREAS, because of conditions and circumstances beyond the control of Integrated Water Services Inc. ("IWS"), it has incurred delays in the performance of its duties for the St. Vrain Water Treatment Plant Project ("Project") ; and WHEREAS, such delays necessitate that the First Amendment to Part 2B Construction Phase of the Town of Firestone and Integrated Services Inc.'s St. Vrain Water Treatment Plant Agreement be amended, specifically that Contract Times, for Substantial Completion be extended from October 25, 2021, to April 4, 2022, and Final Payment be extended from December 24, 20215 to April 25, 2022, as set forth in the attached Change Order No. 1. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO: Change Order No. 1 to the First Amendment to Part 2B Construction Phase of the Town A Firestone and Integrated Water Services Inc.'s St. Vrain Water Treatment Plant Agreement is approved in substantially the same form as the copy attached hereto and made a part of this resolution, and the Mayor is authorized to execute the Change Order on behalf of the Town.
