HomeMy WebLinkAbout21-62 Final Development Plan 19 & 26 Crossings Filing No 1 05-26-2021RESOLUTION N0.21-62 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO, APPROVING A FINAL DEVELOPMENT PLAN FOR CERTAIN REAL PROPERTY LOCATED WITHIN 19 & 26 CROSSINGS FILING NO. 1 WHEREAS, 19 & 26 LLC ("Applicant"), has submitted a proposed final development plan for the Property, entitled "Lot 2, 19 & 26 Crossings Filing No. 1" (the "Final Development Plan"); and WHEREAS, the Firestone Planning &Zoning Commission, after conducting a public hearing on the Final Development Plan on May 6, 2021 rendered a decision recommending approval of the Final Development Plan with five (5) conditions as more fully set forth in PC 21-05, dated May 6, 2021; and WHEREAS, after reviewing the record of the Planning &Zoning Commission public hearing, and after considering the testimony, evidence and argument presented at the Board of Trustees public hearing, the Board of Trustees finds the proposed Final Development Plan to be in substantial compliance with the technical requirements of the Town of Firestone subdivision and zoning ordinances. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO: Section 1. The Board of Trustees acknowledges the Planning &Zoning Commission's findings of fact in this case, as detailed in Resolution PC 21-05. Section 2. The above Recitals and Findings of the Board of Trustees are hereby incorporated into this resolution. Section 3. The Board of Trustees hereby approves the final development plan for Lot 2, 19 & 26 Crossings Filing No. 1, attached hereto as Exhibit A and incorporated herein by this reference, subject to and contingent upon compliance with the following conditions:. (a) Modify plans and application materials pursuant to comments of the Town Engineer set forth in memoranda dated January 19, 2020, to the Town's satisfaction. (b) Technical corrections to the Lot 2, 19 & 26 Crossing Filing No. 1 Final Development Plan shall be made to the Town's satisfaction. (c) Fee -in -lieu of Open Space Dedication in the pro-rata share amount of $55,200.00 shall be paid to the Town prior to the recordation of the Lot 2, 19 & 26 Crossings Filing No. 1 Final Development Plan. (d) The Town of Firestone has determined that the required CBT dedication to be: irrigation demand is 0.31 shares, and the domestic demand is 0.69 shares; a total of 1 share shall be transferred to the Town prior to the recordation of the FDP. (e) No grading permit shall be issued on Lot 2, 19 & 26 Crossings Filing No. 1 Final Development Plan until such time proof of payment has been made to United Power for the relocation of the power pole/equipment located within the northwest corner of Locust Street (WCR 19) and Zinnia Avenue (WCR26). Section 5. The Mayor and Town Clerlc are hereby authorized and directed to certify upon the Final Development Plan the Town's approval and acceptance thereof. The Town Clerk is hereby authorized and directed to file the Final Development Plan with Weld County Clerk and Recorder's office upon fulfillment of all conditions as indicated herein. Section 6. Unless otherwise extended by resolution of the Board of Trustees, the approval of the Final Development Plan shall be null and void if the conditions set forth in Section 3 are not complied with within one hundred and twenty (120) days of the date of this Resolution. THE LOT 1 FDP PROPOSES A NEW 1" WATER METER, FIRE SPRINKLER SYSTEM, AND SINGLE FIRE HYDRANT TO BE INSTALLED WITH THE DEVELOPMENT. THE FIRE HYDRANT AND WATER METER WILL BE DESIGNED AND CONSTRUCTED IN ACCORDANCE WITH THE TOWN OF FIRESTONE DESIGN STANDARDS AND CONSTRUCTION SPECIFICATIONS FOR PUBLIC IMPROVEMENTS. THE SEWAGE DISPOSAL SYSTEM PROPOSED FOR THE PROPERTY IS AN INDIVIDUAL ONSITE SEPTIC SYSTEM. THE PROPOSED FIELD WILL BE LOCATED NORTHWEST OF THE PROPOSED BUILDING. THE SEWAGE DISPOSAL SYSTEM WILL BE PERMITTED BY WELD COUNTY HEALTH DEPARTMENT.
