A RESOLUTION OF THE BOARD OF TRUSTEES OF THE TOWN OF
FIRESTONE, COLORADO APPROVING A SPECIAL REVIEW USE
APPLICATION TO OPERATE OIL AND GAS WELLS AND PRODUCTION
FACILITIES ON REAL PROPERTY LOCATED IN SECTION 19,
TOWNSHIP 2 NORTH, RANGE 67 WEST, WITHIN THE TOWN OF
FIRESTONE
WHEREAS, Kerr-McGee Oil & Gas Onshore LP (“Applicant”), on behalf of Anadarko E&P
Onshore LLC, who is the owner of certain real property located in the Town of Firestone, having a
legal description of NW ¼ of Section 19, 2N, 67W (“Property”), has submitted an application for
Special Review Use to construct and operate a new oil and gas well pad, including 26 wells and one
production facility, to be known as the “McGavin 6-149HZ Well Pad and Facility,” on the Property
(the “Application”); and
WHEREAS, Kerr-McGee Oil & Gas Onshore LP (“Applicant”), on behalf of Anadarko E&P
Onshore LLC, has also submitted an application for a Final Development Plan relating to such
special review use; and
WHEREAS, the Firestone Planning and Zoning Commission, after conducting a public
hearing on the Application on January 6, 2022 rendered a decision recommending denial of the
Application, on the basis that the Application failed to meet certain approval criteria set forth in Step
9, Section 16.7.11.C of the Code (specifically, 16.7.11.C.2.(a); (b); and (d), respectively); and
WHEREAS, after reviewing the record of the Planning and Zoning Commission public
hearing, and after considering all the testimony, evidence, and argument presented at the public
hearing held before the Board of Trustees on January 26, 2022, the Board of Trustees finds and
determines that the Application is complete, and that the Applicant has met the relevant standards to
accommodate oil and gas wells and facilities set forth in Sections 16.6.14 of the Firestone
Development Code (“Code”), the Special Review Use approval criteria set forth in Step 9, Section
16.7.11.C of the Code.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE
TOWN OF FIRESTONE, COLORADO:
Section 1. The Board of Trustees acknowledges the Planning and Zoning Commission’s
recommendation, motion to recommend denial of the Application, and findings made in support of such
motion in this case, as stated on the record made available to the Board of Trustees.
Section 2. The above Recitals and Findings of the Board of Trustees are hereby
incorporated into this resolution.
Section 3. Kerr-McGee Oil & Gas Onshore LP’s application for a Special Review Use to
construct and operate a new oil and gas well pad, including 26 wells and one production facility, to
be known as the “McGavin 6-149HZ Well Pad and Facility,” on the Property, as a special review use
within the existing Residential B (R-B) zone district, is hereby approved, subject to and contingent
upon compliance with the following conditions:
