RESOLUTION NO. 26-41
A RESOLUTION OF THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE,
COLORADO, APPROVING A WIRELESS COMMUNICATIONS FACILITIES LEASE
AGREEMENT WITH ANTHEMNET, INC.
WHEREAS, the Town of Firestone (“Town”) owns that certain parcel of real property legally
described as Lot 3, Minor Plat Advanced Forming Technology (the “Property”); and
WHEREAS, AnthemNet, Inc. (“AnthemNet”) has expressed an interest in leasing a portion of the
Property for the installation, maintenance, and operation of a wireless communications facility (“Project”),
and desires to enter into a long-term lease with the Town to facilitate the Project; and
WHEREAS, the Lease will also require the Town to convey an access and utility easement to
AnthemNet over a small portion of the Property to permit AnthemNet to extend utility services to the
Project; and
WHEREAS, the Town Board of Trustees finds that it is in the best of the Town to lease a portion
of the Property to AnthemNet for the Project and to grant the requested easement to AnthemNet to facilitate
the Lease, pursuant to the terms and conditions contained in a “Wireless Communications Facilities Lease
Agreement” and “Access and Utility Easement,” attached hereto as Exhibit A and Exhibit B, respectively.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE
TOWN OF FIRESTONE, COLORADO:
Section 1. The “Wireless Communications Facilities Lease Agreement” between the Town
and AnthemNet is authorized and approved in the form substantially similar to the form attached hereto as
Exhibit A and made a part of this resolution.
Section 2. The “Access and Utility Easement” between the Town and AnthemNet is
authorized and approved in the form substantially similar to the form attached hereto as Exhibit B and
made a part of this resolution.
Section 3. The Mayor is authorized to execute the Lease Agreement and the Access and
Utility Easement on behalf of the Town.
