HomeMy WebLinkAbout22-33 Preliminary Subdivision Plat Certain Real Property Barefoot Lakes 03-09-2022RESOLUTION N0.22-33 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO, APPROVING A PRELIMINARY SUBDIVISION PLAT FOR CERTAIN REAL PROPERTY LOCATED WITHIN THE BAREFOOT LAKES SUBDIVISION WHEREAS, Barefoot, LLC ("Applicant"), as owner of certain real property located within the Barefoot Lakes subdivision (the "Property"), has submitted a proposed preliminary subdivision plat for the Property; and WHEREAS, the Firestone Planning and Zoning Commission, after conducting a public hearing on the proposed preliminary subdivision plat on February 17, 2022, rendered a decision recommending approval of the Preliminary Plat with two (2) conditions as more fully set forth in PC-22-05, dated February 17, 2022; and WHEREAS, on March 9, 2022, the Board of Trustee conducted a public hearing on the proposed Preliminary Plat; and WHEREAS, after reviewing the record of the Planning and Zoning Commission public hearing, and after considering the testimony, evidence and argument presented at the Board of Trustees public hearing, the Board of Trustees finds and determines that the proposed plat is in substantial conformance with the technical requirements of the Firestone Development Code, and that the proposed development plan meets the applicable requirements and standards set forth in the Firestone Municipal Code and Firestone Development Code. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO: Section 1. The Board of Trustees acknowledges the Planning and Zoning Commission's findings of fact in this case, as detailed in Resolution PC-22-O5. Section 2. The above Recitals and Findings of the Board of Trustees are hereby incorporated into this resolution. Section 3. The Board of Trustees hereby approves the Preliminary Plat of Barefoot Lakes Filing No. 6, attached hereto as Exhibit A and incorporated herein by this reference, which is subject to: (a) All remaining technical corrections to the Barefoot Lakes Filing No. 6 Preliminary Plat and Construction Drawings requested by Town staff shall be made to the Town staff s satisfaction. (b) At the Final Plat stage, the Town and the Applicant shall execute a subdivision agreement, in a form to be approved by the Town Attorney. Section 4. The Preliminary Plat, Barefoot Lakes Filing No. 6, Town of Firestone, Weld County, State of Colorado, attached hereto as Exhibit A and incorporated herein by this reference, is hereby approved, subject to and contingent upon compliance with the following conditions: (a) All remaining technical corrections to the Barefoot Lakes Filing No. 6 Preliminary Plat and Construction Drawings requested by Town staff shall be made to the Town staff's satisfaction. (b) At the Final Plat stage, the Town and the Applicant shall execute a subdivision agreement, in a form to be approved by the Town Attorney. Section 5. Unless otherwise extended by the Board of Trustees, the approval of the Barefoot Lakes Filing No. 6 Preliminary Plat shall be null and void if a final plat for all or a portion of the property is not approved by the Town of Firestone within three years of the date of this Resolution.
