HomeMy WebLinkAbout22-35 Prescribing Water Rates, Fees, Tolls & Charges & Storage & Infastructure Investment fees 03-09-2022RESOLUTION N0.22-35 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO, PRESCRIBING THE TOWN OF FIRESTONE'S WATER RATES, FEES, TOLLS AND CHARGES AND STORAGE AND INFRASTRUCTURE INVESTMENT FEES WHEREAS, the Town of Firestone ("Town") for administrative efficiency by Resolution NO. 21499 consolidated its water rates, fees, tolls and charges and storage and infrastructure investment fees in one resolution; and WHEREAS, the Town, which operates a municipal water facility and Central Weld County Water District ("CWCWD") are parties to various intergovernmental agreements concerning the provision of water service and facilities to the Town; and WHEREAS, pursuant to such intergovernmental agreements, CWCWD from time to time increases its charges regarding its provision of water services to the Town; and WHEREAS, after review and analysis of the costs of operating and maintaining the Town's water system, including completion of a water rate study and an analysis of capital needs, and in consideration of applicable CWCWD increases and increases in the costs of operating, maintaining and improving the Town's water system, the Board of Trustees determined that increases in the Town's water system rates, fees, tolls and charges were necessary; and WHEREAS, the Town's current water tap fees and monthly water rates did not adequately provide for the capital needs and operations of the Town's water system; and WHEREAS, the Board of Trustees thus desired to increase certain rates, fees, tolls and charges regarding the provision of Town water services and water usage, and WHEREAS, the Town's determination of Native Water Dedication Credits pursuant to the Town's Native Water Dedication Policy includes storage and delivery system development costs which it seeks to recover through the enactment of storage and infrastructure investment fees; and WHEREAS, upon completion of the determination of the Towns water capital needs and operational costs and storage and delivery system development costs the Town established water rates, fees, tolls, and charges and storage and investment fees which were set forth in Resolution NO. 21- 199, which was adopted by the Board of Trustees on December 8, 2021; and WHEREAS , to ensure that all such rates, fees, tolls and charges and storage and investment fees remain reasonably related to the Town's costs staff has examined all those set forth in Resolution N0.21-199 and recommends but one amendment which is to increase the construction hydrant meter rental deposit from $3,200.00 to $4,200.00 per meter. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO: E Section 1. Water rates and charges. Connection, Capital Investment and Repair Fees. The following connection and capital investment and repair fees shall be imposed, except that the Town of Firestone shall not be required to pay such connection fees for irrigation sprinkler systems for any public parks, rights -of --way, open space, or medians, or any facility developed, owned or paid for by the Town. Meter Size Total 5/8" $ 12,800 3/4" $ 19,200 1" $ 3200 1-1/2" $ 6600 2" $ 106,400 Connection and capital investment and repair fees as well as any other fees for taps requiring a meter larger than 2" shall be determined by the Board of Trustees on an individual basis considering such factors as type of use, contemplated volume demand for water, effect on the entire water system in the Town, connection and capital investment fees imposed by CWCWD, and all other factors relevant to the application. All taps requiring a meter larger than 2" and all taps applied for where the service requested is outside of the Town limits shall be by contract with the Board of Trustees. Out-of-town taps of 2" or less shall be charged fees at two times the amount of in -Town fees. Section 3. Construction Hydrant Meter Rental Terms. The following fees shall be imposed for hydrant meters supplied by the Town for construction water use. A Hydrant Connection Permit must be obtained from the Town Clerk prior to any water being used from any fire hydrant. Such permit shall be valid for a period not to exceed 6 months. This Resolution shall take effect on March 10, 2022 and upon such date all prior resolutions addressing the Town's water rates, fees, tolls and charges and storage and infrastructure investment fees set forth herein shall be repealed in their entirety.
