HomeMy WebLinkAbout20-64 Approval Town Manager Temp Admin Order Waive Land Use Licensing Reqs 06-10-2020RESOLUTION N". 20-64 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO, APPROVING THE TOWN MANAGERS ISSUANCE OF A TEMPORARY ADMINISTRATIVE ORDER REGARDING THE SUSPENSION OF CERTAIN LAND USE AND LICENSING REQUIREMENTS TO FACILITATE THE OPERATION OF OUTDOOR BUSINESS ACTIVITIES WHEREAS, upon its continuance of the local Declaration of disaster issued by the Town Manager on March 18, 2020, the Board of Trustees directed the Town Manager to as appropriate and necessary address the local disaster and its impact related to the protection of the public health, safety and welfare; and WHEREAS, since March 25, 2020, Governor Polis has issued a series of Executive Orders concurrent with Public Health Orders issued by the Colorado Department of Public Health and Environment ("CDPHE") implementing and now lessening restrictions to address the impacts of COVID49; and WHEREAS on May 25, 2020, Governor Polis by Executive Order in conjunction with guidance provided by a Public Health Order issued by CDPHE, encouraged restaurants to have outdoor dine in service and indoor service subject to restrictions concerning occupancy, social distancing, facial coverings, means of payment and employee protection measures; and WHEREAS, during the same period of time, the Colorado Department of Revenue Liquor Enforcement Division issued an Emergency Regulation which permits Hotel and Restaurant and other liquor licensees to temporarily expand their licensed premises to sidewalks, streets and parking lots to increase social distancing while being able to operate a productive and economically sustainable business; and WHEREAS, to facilitate the operation of outdoor business activities and provide needed flexibility to such businesses, the Town Manager has issued a Temporary Administrative Order suspending certain Town land use and licensing requirements which will benefit both the businesses and the members of the community. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO: In support of the Board of Trustees desire to assist both the business community and the Town's citizens in dealing with the financial and social impacts of COVID 19 it does hereby approve the Town Manager's Disaster Emergency Order No. 1 in substantially the same form as the copy attached hereto and made a part of this resolution. MARCH log LULU TOWN OF FIRESTONE, COLORADO DECLARATION OF LOCAL DISASTER WHEREAS, in accordance with the Colorado Disaster Emergency Act ("Act"), C.R.S. § 24-33.5-7 on March 101 2020, Governor Jared Polis, by proclamation, declared a state of emergency in Colorado to provide access to resources, legal flexibility, and protect vulnerable communities, all to better contain the outbreak of the COVID- 19 virus; and WHEREAS, in accordance with C.R.S. §24-33.5-709, a local disaster may be declared only by the principal executive officer of the Town ("Town Manager"), and shall not be continued for a period in excess of seven days, absent the consent of the Town Board; and WHEREAS, in accordance with C.R.S. §24-33.5-709, the Town Manager's declaration of a local disaster activates the Carbon Valley Emergency Operation Plan, of which the Town is a member; and WHEREAS the purpose of the Plan is to provide a coordinated framework working with local, county, state and federal entities to mitigate, prevent, protect, respond and recover from disasters; and WHEREAS, the Plan includes the Carbon Valley Pandemic Influenza Response which coordinates local, county, state, and federal responses, and which in addition to general public measures, such as social distancing, communication updates and implementation of health and safety measures, provides for the Town's ability to implement personnel policies for its employees, such as amending work schedules and rules, and designating and assigning "essential personnel". NOW, THEREFORE, I, AJ KRIEGER, TOWN MANAGER OF THE TOWN OF FIRESTONE, COLORADO, DECLARE AND DIRECT, AS AUTHORIZED BY LAW, THE FOLLOWING: Section 1. That the COVID 19 virus constitutes a local disaster for the Town which endangers the health, safety and welfare of the entire community and emergency action is required to avert such danger. Section 2. That the effect of this Declaration of Local Disaster shall be to activate the response and recovery aspects of any and all applicable local, inter jurisdictional, state and federal disaster emergency plans, and to seek and authorize the furnishing of aid, assistance, and financial reimbursement under such plans. Section 3: That the Town's residents, businesses and visitors are encouraged to remain informed, and to follow the U.S. Center for Disease Control guidance for mitigation strategies concerning the COVID-19 virus. Section 4. The Town Clerk is directed to immediately publish and file copies of this Declaration of Local Disaster with the Weld County Emergency Manager, the Colorado Office of Emergency Management, and the Weld County Clerk and Recorder.
