A RESOLUTION OF THE BOARD OF TRUSTEES OF THE TOWN OF
FIRESTONE, COLORADO, APPROVING A PRELIMINARY
SUBDIVISION PLAT AND PRELIMINARY DEVELOPMENT PLAN FOR
CERTAIN REAL PROPERTY LOCATED WITHIN THE COTTONWOOD
HOLLOW SUBDIVISION
WHEREAS, Mortgage Consultants, LLC ("Applicant"), as owner of certain real property
located within the Cottonwood Hollow subdivision (the "Property"), has submitted a proposed
preliminary subdivision plat and preliminary development plan for the Property; and
WHEREAS, the Firestone Planning and Zoning Commission, after conducting a public
hearing on the proposed preliminary subdivision plat and preliminary development plan on June
18, 2020, rendered a decision recommending approval of the Preliminary Plat and Preliminary
Development Plan with five (5) conditions as more fully set forth in PC-20-10, dated June 18,
2020; and
WHEREAS, on July 8, 2020 and on August 26, 2020, the Board of Trustee conducted a
public hearing on the proposed Preliminary Plat and Preliminary Development Plan; and
WHEREAS, after reviewing the record of the Planning and Zoning Commission public
hearing, and after considering the testimony, evidence and argument presented at the Board of
Trustees public hearing, the Board of Trustees finds and determines that the proposed plat is in
substantial conformance with the technical requirements of Title 16 of the Firestone Municipal
Code, and that the proposed development plan meets the applicable requirements and standards
set forth in the Firestone Municipal Code and Firestone Development Regulations.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE
TOWN OF FIRESTONE, COLORADO:
Section 1. The Board of Trustees acknowledges the Planning and Zoning Commission's
findings of fact in this case, as detailed in Resolution PC-20-10.
Section 2. The above Recitals and Findings of the Board of Trustees are hereby
incorporated into this resolution.
Section 3. The Board of Trustees hereby approves the Preliminary Plat of Cottonwood
Hollow Filing 4, attached hereto as Exhibit A and incorporated herein by this reference, which is
subject to:
(a) All existing encumbrances on proposed lots shall be vacated, removed, and/or
relocated prior to Final Plat recordation.
(b) Improvements, landscaping, and trails within existing easements or encumbered areas
to remain shall be acceptable to the easement owner or entitled entity and the Town prior to Final Plat
recordation. Any agreements with easement owners such as Ditch Companies shall be fully executed
prior to Final Plat approval.
(c) Easements for off -site infiastructure improvements shall be required prior to Final Plat
recordation.
(d) Technical corrections to the Cottonwood Hollow Filing 4 shall be made to the Town's
satisfaction.
(e) No lots within the FEMA 100-year floodplain shall be included in any Final Plat until
a Letter of Map Revision (LOMR) is fully completed with FEMA removing said areas from the 100-
year Floodplain.
Section 4. The Mayor is authorized to sign the preliminary plat on behalf of the Town.
Section 5. The Preliminary Development Plan, Cottonwood Hollow Filing 4, Town of
Firestone, Weld County, State of Colorado, attached hereto as Exhibit B and incorporated herein
by this reference, is hereby approved, subject to and contingent upon compliance with the following
conditions:
(a) All existing encumbrances on proposed lots shall be vacated, removed, and/or
relocated prior to Final Plat recordation.
(b) Improvements, landscaping, and trails within existing easements or encumbered areas
to remain shall be acceptable to the easement owner or entitled entity and the Town prior to Final Plat
recordation. Any agreements with easement owners such as Ditch Companies shall be fully executed
prior to Final Plat approval.

(d) Technical corrections to the Cottonwood Hollow Filing 4 shall be made to the Town's

Section 6. Unless otherwise extended by the Board of Trustees, the approval of the
Cottonwood Hollow Filing 4 Preliminary Plat shall be null and void if a final plat for all or a
portion of the property is not approved by the Town of Firestone within three years of the date of
this Resolution.
