Town Hall Project 04-28-2021RESOLUTION N0.21-60 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO, APPROVING A CHANGE ORDER TO THE TOWNS CONSTRUCTION SERVICES AGREEMENT WITH FRANSEN PITTMAN CONSTRUCTION CO., REGARDING THE TOWN HALL PROJECT WHEREAS, by Resolution No. 20-92 the Town of Firestone ("Town") entered into a Construction Services Agreement with Fransen Pittman Construction Co, for the Town Hall Construction Project ("Project"); and WHEREAS, upon commencement of the Proj ect's work it was determined that the existing detention pond did not meet the requirements of the sites existing Police and Municipal Court Facility and would need to be upgraded to meet the needs of both the existing facility and the Town Hall Project, and WHEREAS, in accordance with the parties Agreement performance of the additional work requires that the Board of Trustees approve a Change Order. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO: The Change Order of the Town Hall Construction Services Agreement between the Town of Firestone and Fransen Pittman Construction Co. for improvement to the sites existing detention pond is approved in substantially the same form as the copy attached hereto and made a part of this resolution and the Mayor is authorized to execute the Change Order on behalf of the Town. Our proposal is based on Erosion and Sediment Control Plan sheet C4 (4 Of 6) 02/04/2021 by Coffee Engineering and Surveying. If permits are required, fees shall be reimbursed at cost. 9) Pricing is based upon a 2021 installation schedule. 10) Private locates are not included. 11) Bond is not included. 12) Sales tax is included at 6.5% per City of Firestone. 13) Textrua Fees are inluded. 14) Due to Terrascapes not being onsite throughout the project, it in the General Contractors responsibility to notify Terrascapes of sleeving installation schedules. Failing to do so may result in added costs. 15) All warranty walks MUST be conducted with a representative from Terrascapes present during the walk, 16) Plans sets listed above are the only plans utilized for this proposal, all other plan sets should be considered unpriced and therefore have been excluded. 17) Additional Exclusions: any/all concrete/asphalt, crane/hoisting services, boring/coring, drainage materials- including drainage systems of any kind, winter watering, any work that exists within the building — stub outs/electrical for irrigation must be supplied by others, grade requirements listed above, temporary irrigation, synthetic turf, fencing, retaining walls, site lighting, waterproofing, pavers, site furnishings, erosion control of any kind (including blankets). CLARIFICATIONS 1. Terrascape supervisors are OSHA Certified. 2. We can provide a detailed cost breakdown before beginning the work 3. We can provide a written schedule for the progress of the work upon request. 4. Terrascapes will not be in breach of this agreement while prevented from performing due to threats/act of terrorism, labor shortages due to act of government affecting allotment of visas, earthquake, and other acts of God. 5. If contractor does not commence work pursuant to schedule, Terrascapes will be entitled to review its labor availability and labor costs, as well as its material availability/costs, and may re -bid the project to account for any changes in such availability and/or costs. 6. We will always leave the job in a clean and orderly condition. 7. We will provide you with a list of the subcontractors that we intend to hire. 8. We will honor warranties in a timely manner. This revision includes 24 additional cubic yards of type VL grouted riprap. Pricing is produced from plans dated 02/04/21 and cut fill report provided by Fransen Pittman. Please note that we have priced approximately 100 cubic yards of material to be moved and imported to the site. If quantities change cost shale be negotiated. We have excluded any FES headwall, due to having a detail included within the plan set, however, we are unable to find any proposed FES on the grading or pond improvement plan sheet. If you have any questions, please do not hesitate to contact me.
