HomeMy WebLinkAbout1043 Approving an Application to Amend Barefoot Lakes Outline Development Plan 06-12-2024ORDINANCE NO. 1043 AN ORDINANCE OF THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO APPROVING AN APPLICATION TO AMEND THE BAREFOOT LAKES OUTLINE DEVELOPMENT PLAN WHEREAS, Barefoot LLC, (the "Applicant"), as the owner of certain real property located within the Town of Firestone, Colorado (the "Property"), has submitted an application to amend the existing Barefoot Lakes Outline Development Plan (the "Original ODP") as it relates to the areas of the Original ODP north of Ronald Reagan Blvd, including renaming the document to the Barefoot PUD (the "Application"); and WHEREAS, the Firestone Planning and Zoning Coinrnission, after conducting a public hearing on the proposed Application on June 6, 2024, rendered a decision recommending approval of the Application with one (1) condition as more fillly set forth in PC-24-03, dated June 6, 2024; and WHEREAS, on June 12, 2024, the Board of Trustees conducted a public hearing on the Application; and WHEREAS, after reviewing the recommendation of the Planning and Zoning Commission, and after considering the testimony, evidence and argument presented at the Board of Trustees public hearing, the Board of Trustees finds and determines that the proposed Application is in substantial conformance with the technical requirements of the Firestone Development Code, and that the proposed development plan meets the applicable requirements and standards set forth in the Firestone Municipal Code and Firestone Development Code. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO: Section 1. The Board of Trustees acknowledges the Planning and Zoning Commission's recommendation in this case, as detailed in Resolution PC-24-03. Section 2. The above Recitals and Findings of the Board of Trustees are hereby incorporated into this ordinance. Section 3. The Board of Trustees hereby approves the Barefoot PUD, attached hereto as Exhibit A and incorporated herein by this reference, which is subject to: 1. All remaining technical corrections to the Barefoot PUD requested by Town staff shall be made to the Town staffs satisfaction. Section 4. The Board of Trustees directs that a certified copy of this Ordinance be filed with the Town Clerk and fiirther, that the Town Cleric index, file and make the Ordinance available to the public. Section 5. If any article, section, paragraph, sentence, clause or phrase of this ordinance is held to be unconstitutional or invalid for any reason, such decision will not affect the validity or constitutionality of the remaining portions of this ordinance. The Board of Trustees hereby declares that it would have passed this ordinance and each part or parts hereof irrespective of the fact that any one part or parts be declared unconstitutional or invalid. Section a. All other ordinances or portions thereof inconsistent or conflicting with this ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict.
