("Hendrickson") entered into an Agreement for Preconstruction and Construction Administrative Services for the Weld County Road 26 ("Road 26") and Last Chance Ditch Replacement Project ("Project"); and WHEREAS, upon Hendrickson's initial Right -of -Way ("ROW") research it was determined that Road 26's centerline was not centered in the Town's existing ROW; and WHEREAS, Hendrickson must therefore perform additional ROW acquisition, survey, environmental, permitting and review tasks as set forth in the Change Order; and WHEREAS, as such work is necessary to complete the Project, staff recommend that the Board of Trustees approve Change Order # 1. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO: Change Order #1 of the Preconstruction and Construction Administrative Services for the Weld County Road 26 and Last Chance Ditch Bridge Replacement Project is approved in substantially the same form as the copy attached hereto and made a part of this resolution and the Mayor is authorized to execute the Change Order on behalf of the Town. Kiran: Short Elliott Hendrickson Inc. (SEH) appreciates the opportunity to provide a proposal for additional professional services to the current structure replacement design project for the structure carrying Weld County Road 26 over Last Chance Ditch. The services included in this proposal are additional to the services included in the original design scope. They have been determined to be needed to complete the design of the project based on information collected in preparation for the FIR level submittal for the project. The vertical utility locating (potholes) are in addition to the pothole quantities included in the original proposal and based on horizontal locating and records research performed to this stage of the project. The ROW services were not anticipated at the onset of the project and were determined to be needed after survey and ROW research determined the existing road centerline was not centered in the existing Town ROW. The 404 permit was not anticipated to be needed because the waterway is an irrigation ditch but has been determined to be required by CDOT. Professional services scope for each site includes: 1. Project Management a. General coordination/correspondence related to additional services b. Subconsultant contracting/coordination/management c. ROW Plan Review (ROWPR) meeting with CDOT 2. Professional services during design phase a. ROW plans in CDOT format for acquisition from 2 parcels b. CDOT ROW Plan review comment incorporation (2 Rounds of comment incorporation included) c. Legal Descriptions (4 Total including 2 ROW Acquisition and 2 Temporary Easements) d. ROW staking (1 site visit to stake proposed ROW for property owner meetings) e. QL-A testholes — 6 holes in addition to the originally anticipated scope f. Testhole survey and logs for 6 additional test holes. g. ROW Acquisition services including Title Reports for/from 2 properties (See attached proposal from Western States Land Services, LLC.) Professional services during construction phase a. Setting ROW monuments (up to 6 total) for new ROW corners, performed after Contractor has substantially completed construction. Deliverables: 1. Pothole logs and incorporation into plan sheets for additional potholes 2. CDOT format ROW plans and CDOT review comment response documentation 3. 404 permit figures and application documents 4. Title Reports for 2 parcels, assuming 1 re -order for each parcel 5. ROW acquisition documentation in accordance with CDOT acquisition requirements Scope Assumptions and Exclusions: I. Anything not explicitly included in the scope is explicitly excluded from the scope. 2. This proposal is based on the attached preliminary ROW exhibit. This exhibit is preliminary and the extents of the acquisition and easements may change. 3. The proposal is based on ROW acquisition and temporary easements from 2 properties. 4. The ROW scope assumes waiver valuations are appropriate for the ROW acquisition services, and appraisals are not included. 2 independent appraisal reviews are included if the property owner(s) choose to perform their own appraisal(s). The appraisal reviews are required to comply with the CDOT ROW process. 5. The 404 permit is assumed to be a Nationwide Permit (NWP). Costs: Our anticipated not -to -exceed fee including labor and expenses for the services included in this proposal are provided in an attachment to this letter. Schedule: Adding ROW acquisition services to the design scope will extend the duration of the project. ROW acquisition duration can vary significantly depending on many factors, so it is challenging to estimate. ROW acquisition could extend the project by up to 6-12 months, but we anticipate for this project it will be on the shorter side of this duration. SEH will incorporate ROW acquisition into the project design schedule and share with the Town at appropriate project milestones. Additional Services: We will also furnish such Additional Services as you may request. Payment for additional services shall be based on the time required to perform the services and the billable rates for the employees engaged directly on the project, plus charges for expenses and equipment. As with all of our work, we note that the fee estimated above is not a fixed bid and we would only charge for the actual time and expenses incurred during the conduct of our acquisition services. This estimate is based on our current fee schedule which will remain the same through 2024. TINGLE AS SUBSITUTE MUNICIPAL COURT JUDGE WHEREAS, The Municipal Court Judge, Steven Jones has requested that to ensure the efficient operation of the Court that the Board of Trustees appoint a substitute judge in the event that he is unable to serve on a court date; and WHEREAS Judge Stevens recommends that Charles W. Tingle be appointed to serve as the substitute judge; and WHEREAS the Board of Trustees upon being advised that Mr. Tingle served as, a District Attorney in the Office of the District Attorney for the First Judicial District for thirty- seven years rising to the second highest position to Assistant District Attorney, Special Assistant to the United States Attorney, Colorado Supreme Court Nominating Commission Member, First Judicial District Judicial Performance Commission Member, and is currently a substitute judge for the Lakewood, Westminster and Broomfield Municipal Courts finds that Mr. Tingle is qualified to serve as the substitute judge for the Firestone Municipal Court. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO: 1) That Charles W. Tingle is appointed to serve at the will and pleasure of the Board of Trustees as the Substitute Judge for the Firestone Municipal Court. 2) Mr. Tingle shall be compensated at the rate of $120.00 per hour for his services as the Substitute Judge.
