HomeMy WebLinkAbout24-79 Approving Special Review Use Application to Operate Family Child Care Home 08-14-2024WHEREAS, Maribel Z. Urbina (the "Applicant"), who is the owner of certain real property located in the Town
of Firestone, having a legal description of Lot 5, Block 2, Oak Meadows PUT) Filing I (the "Property"), has submitted an
application for Special Review Use to operate a Family Child Care Home (Large) (the "Application"); and
WHEREAS, the Firestone Planning and Zoning Commission after conducting a public hearing on the
Application on August 1, 2024, rendered a decision recommending approval of the Special Review Use with conditions
set forth in PC-24-04, dated August 1, 2024; and
WHEREAS, after reviewing the Planning and Zoning Commission's recommendation, and after considering the
testimony, evidence and argument presented at the Board of Trustees public hearing, the Board of Trustees finds and
determines that the proposed Special Review Use is insubstantial conformance with the technical requirements of the
Firestone Development Code.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF
FIRESTONE, COLORADO:
Section 1. The Board of Trustees acknowledges the Planning and Zoning Commission's recommendation and
findings of fact in this case, as detailed in Resolution PC-24-04.
Section 2. The above Recitals and Findings of the Board of Trustees are hereby incorporated into this
resolution.
Section 3. The Board of Trustees hereby approves the Special Review Use, subjeetto the following conditions:
a. The Applicant shall obtain a Firestone Business License before operating the proposed use.
b. Special Review Use approval shall not authorize the use or conversion of the facility to a
commercial use facility.
