A RESOLUTION OF THE BOARD OF TRUSTEES OF FHE TOWN OF
FIRESTONE, COLORADO, APPROVING A MINOR SUBDIVISION PLA-T;
AND ACCEPTING THE PROPERTY INTERESTS DEDICATED BY THE
MINOR PLAT FOR CERTAIN REAL PROPERTV LOCATED WITHIN
THE TOWN OF FIRESTONE
WFlERE'AS, Robert B. Compton and Denny 1— Compton as to Parcel A and Pasquale Varra
(deceased) and Jacqueline Varra as to Parcel B (Applicants"). as owners of'certain real property
described on Exhibit A (tile -Property—), have submitted a proposed Subdivision plat for the 11'ropetty,
entitled "Varra-l-leintzelman Pit Sul-,fiv'ision, Amendment No. I" (the "Minor Plat"); and
W1 IF"REAS. after reviewing the evidence and argurnent presented to the Board ol"Frustees,
the Board of-frustees finds the proposed Minor Plat to be in substantial compliance with the technical
requirements of the f,irestone Development Code.
NOW, TFIERElORE. BE IT RES01,VED BY TIJE BOARD OF TRIJSTEES 01" TFIE
TOWN OFFIRESTONE, COt,ORADO-.
Section I. The above Recitals and Findings of the Board of Trustees are hereby
incorporated into this resolution,
Section 2. The Board of Trustees hereby approves the subdivision plat for Varra-
Heirazelman Pit Subdivision, Aniendnient No, I Minor plat, attached hereto as Exhibit A and
incorporated herein by this reference, sublect to and contingent upon compliance with the following
conditions:
(a) All minor, technical corrections to the Varra- Hei razei man Pit Subdivision,
Amendment No, I Minor plat shall be made to the 1-own's satisfaction.
(b) Applicants shall provide an updated title corrunitntent for tile subject
property contained within the Minor Plat when the mylars are provided tior recording, dated
no later than thirty (30) (lays prior to submission of mylars.
Section 3. The dedication of all easements and all other places designated fior public
use to the Town and as shown upon the Varra-ffeint zelman Pit SUbdivision, Amendment No. I
Minor Plat is hereby accepted by the Town of Firestone; subject however. to the following
conditions:
(a) that acceptance in no way obligates the Tov,,n of Firestone lot- the
financing, construction, or maintenance of public improvements within such easements
or other places designated for public use; and
(b) that the Town shall not undertake maintenance of arry casement or other
place designated for public Use L111til after constrUCti011 of' all necessary public
improvements has been satisfactorily completed by the land owner and accepted in writing
by the Town of Firestone,
Section 4 The N/layor and To-wn Clerk are hereby authorized and directed to certify
upc)n the subdivision plat the 'Fown's approval and acceptance thereof. The Town Clerk is hereby
authorized and directed to file the subdivision plat with Weld County Clerk and Recorder's office
uport fulf illment of all conditions as indicated herein.
Section 5,. Unless otherwise extended by resolution of the Board ot"Frustees, tile approval
of the �I�arratleintzehnan Pit Subdivision, Amendment No. I Minor Plat shall lie nni'll and void it'
the conditions set forth in Section 2 are not complied with within one hundred and twenty ( 120)
days of the date of this Resolution.
