HomeMy WebLinkAbout23-101 Establishing Persons Per Dwelling Unit & Establishing the Neighborhood Park Construction Fee 11-8-2023RESOLU"FION NO. 23-101 A RESOLUTION OF THE BOARD OF TRUSTEES OF THETOWN OF FIRESTONE, COLORADO, ESTABLISHING THE PERSONS PER DWELLING UNITAS REQUIRED FOR CALCULATING THE TOWNS PARKLANDS DEDICATION REQUIREMENT AND ESTABLISHING THE NEIGHBORHOOD PARK CONSTRUCTION FEE WHEREAS, Sections 16.6.3,13.3 and 16.6.3.C,3 of the Firestone Development Code ('-FDC") establish a formula for determining the amount of parkland and open space lands required to be dedicated ("Park -lands Dedication Requirement" and "Open Space Dedication Requirement-) for any person seeking to develop any area zoned for residential purposes ("Residential Developers-) within theTown of Firestone ("Town"), and WIERE AS, pursuant to the FDC. and for purposes of calculating the Parklands Dedication Requirement and Open Space Dedication Requirement, the Director of Planning and Development (-Director") must deterrmne, at least once every five years, upon data compiled by the Town, the number of persons per dwelling unit within the Town; and WHEREAS, the Director has made such calculation and deternlined that there are 3,34 persons per single-family dwelling and 1 .62 persons per multi-farnily dwelling; and WHEREAS, Section 16,6.3.B,S also obligates Residential Developers to bear the costs of designing, constructing, and installing neighborhood parks within their Proposed developments or, in -lieu -of such obligation, pay a cash fee 1-Neighborhood Park Construction Fee") to the Town in accordance with Section 16.6,3,B.8 of the FDC; and WHEREAS, the Board of Trustees, by duly -adopted resolution, establishes the Neighborhood Park, Construction Fee, provided-, however, that such fee must accurately reflect the average design and construction costs per acre to improve land as a neighborhood park, consistent with the criteria of the adopted Pos,r Master Plan-, and WHEREAS, the Board of Trustees has deten-nined the current construction costs to improve land within the town as a neighborhood park in accordance with the FDC to be $420,000 per acre, based on the Director's recommendation; and WHEREAS, the Board of rrustees further determines that the FDC does not require the Town to annually update the Neighborhood Park Construction Fee: rather; the Board of Trustees finds that the FDC permits the Neighborhood Park, Construction Fee to be adjusted administratively by the Director or such person' s designee up to the annual amount of the change in the Engineering News Record Construction Cost Index for the Denver Metropolitan Area because the fee is intended to be grounded upon the current construction costs of recreational facilities; and WHEREAS, staff recommends that the Board of Trustee's adopt the 3.34 persons per single- farn i ly dwelling unit, 1.62 persons per multi -tardily dwellings, and a Neighborhood Park - Construction Fee of S420,000 per acre. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO: Sectioni. The Board of Trustees for the purpose of detertnining the Town's parklands and open space lands dedication requirements does hereby adopt the Director of Planning and Development's determination of 3.34 persons per single-family dwelling and 1.62 persons per multi -fancily dwelling within the Town. Section 2. pursuant to Section 16.6.3.B.8.a of the FDC, the Board of Trustees establishes the Neighborhood Park Construction Fee to be $420,000 per acre. Section 3. ,The Neighborhood Park Construction Fee established in Section 2 may be adjusted administratively by the Director or sucb Person's designee tip to the annual average amount of or percentage change, if any, in the Engineering News Record Construction Most Index (CCI) for the Denver Metropolitan Area. Any fee adjustment greater than the annual arnount of change in the CCI shall require Board approval. Section 4. Upon the effective date of this resolution, the persons per tbvelling unit figures and Neighborhood Park Construction Fee established in Sections I and 2 of this resolution, respectively, shall supersede the persons per dwelling unit figures and Neighborhood Park - Construction Fee values established in all prior resolutions adopted pursuant to Subsection Ito. 6,3,B,8.a of the FDC. Section 5. This resolution is not intended to, and shall not be construed to, establish a preference for payment of the Neighborhood Park Construction Fee in lieu of tile requirement to construct and install a neighborhood park pursuant to Section 16.6.3.B.5 of the FDC.
