HomeMy WebLinkAbout1053 Repealing Reenacting and Retitling Chapter 12.36 Special Event Permits of the Municipal Code 10-09-202411 ; 1 ZEW11jD1►t1X113*j AN ORDINANCE OF THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO, REPEALING, REENACTING AND RETITILING IN ITS ENTIRETY CHAPTER 12.36 SPECIAL EVENT PERMITS OF THE FIRESTONE MUNICIPAL CODE WHEREAS, the Town has updated its administrative process and procedures for special events and thus must amend the Municipal Code so it s compliant with the updated administrative procedure. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO: Section 1. Chapter 12.36 Special Event Permits of the Firestone Municipal Code is repealed reenacted, and retitled in its entirety, to provide as follows: Chapter 12.36 — External Special Event Permits 12.36.020 Definitions The following words and phrases, whenever used in this chapter, shall have the following meanings: "Director" means the Director of Marketing & Communications or their designee. External Special Event ("Event") means an organized procession or assembly of people requiring the exclusive use of all or a portion of a public right-of-way, public park, recreation area, or other Town facilities, which may require the temporary closure of public rights -of -way; and or traffic control. Examples of such events include, but are not limited to, festivals, celebrations, carnivals, races, parades, fundraisers, fairs, rodeos, camps, and other similar activities. 12.36.030 Permit required Any person desiring to conduct an Event must obtain a permit issued by the Director in accordance with the External Special Event Policy and pay all application fees. 12.36.040 Denial and Revocation The Director may deny any application for reasons which include but are not limited, the requested location is not available, the size, activities or nature of the event present a risk of damage to Town property, or endanger the public, the event is of such size or nature that it requires the diversion of police or other town personnel such that it impairs the Town's operations and duties, the application is not complete or contains false information, or the applicant has failed to obtain the required insurance. The Director may revoke any permit for reasons which include but are not limited to, the applicant has failed to comply with the conditions of the permit, or has violated any ordinances or other regulations of the Town or when the events activities present an immediate danger to the health, safety, or welfare of the participants or public. 12.36.050 No rights conferred This chapter does not grant any applicant any rights, or other legal interest in any Town property or facility. Section 2. If any article, section, paragraph, sentence, clause, or phrase of this ordinance is held to be unconstitutional or invalid for any reason, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The Board of Trustees hereby declare it would have passed this ordinance and each part or parts hereof irrespective of the fact that any one part or parts be declared unconstitutional or invalid. Section 3. Violations of this ordinance shall be punishable in accordance with Section 1.16.010 of the Municipal Code of the Town of Firestone, Colorado. Section 4. All other ordinances or portions thereof inconsistent or conflicting with this ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict.
