HomeMy WebLinkAbout24-47 Approving a Preliminary Plat for Property Located within Frontier Estates Filing 1 07-24-2024RESOLUTION NO.24-47 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO, APPROVING A PRELIMINARY SUBDIVISION PLAT FOR CERTAIN REAL PROPERTY LOCATED WITHIN THE FRONTIER ESTATES FILING NO. 1 SUBDIVISION WHEREAS, Melissa Leyba, Kip Farnsworth, and Michael Farnsworth (together, the "Applicant"), as owners of certain real property located within the Frontier Estates Filing No. 1 subdivision, and legally described as Lot 1 and Tract A, Frontier Estates Filing No. 1 (the "Property"), has submitted a proposed preliminary subdivision plat for the Property; and WHEREAS, the Firestone Planning and Zoning Commission, after conducting a public hearing on the proposed preliminary subdivision plat on April 4, 2024, rendered a decision recommending approval of the Preliminary Plat with two (2) conditions as more fully set forth in Resolution PC-24-02, dated April 4, 2024; and WHEREAS, on May 8, 2024, June 12, 2024, and July 24, 2024, the Board of Trustees conducted a public hearing on the proposed Preliminary Plat; and WHEREAS, after reviewing the Planning and Zoning Commission's recommendation, and after considering the testimony, evidence and argument presented at the Board of Trustees public hearing, the Board of Trustees finds and determines that the proposed plat is in substantial conformance with the technical requirements of the Firestone Development Code, and that the proposed subdivision development meets the applicable requirements and standards set forth in the Firestone Municipal Code and Firestone Development Code. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO: Section 1. The Board of Trustees acknowledges the Planning and Zoning Commission's recommendation of approval in this case, as detailed in Resolution PC-24-02. Section 2. The above Recitals and Findings of the Board of Trustees are hereby incorporated into this resolution. Section 3. The Board of Trustees hereby approves the Preliminary Plat of Frontier Estates Filing No. 2, attached hereto as Exhibit A and incorporated herein by this reference, which is subject to the following conditions: (a) All remaining technical corrections to the Frontier Estates Filing No. 2 Preliminary Plat and preliminary Construction Drawings requested by Town staff shall be made to the Town staff's satisfaction. (b) At the Final Plat stage, the Town and the Applicant shall execute a subdivision agreement, in a form to be approved by the Town Attorney. (c) The Applicant may not install or employ any bollard or other obstructions for use within the Purdue street connection within the proposed subdivision, nor incorporate barriers, security piers, or any other street access control devices into the Purdue street connection design that would block or prevent circulation between the proposed subdivision and the adjoining Saddleback Heights subdivision or that would otherwise inhibit to safe, efficient and free movement of vehicular and pedestrian traffic through the proposed subdivision and the adjacent Saddleback Heights subdivision, and this requirement must also be a condition of final plat approval. At the Final Plat stage, the Applicant shall also provide revised Construction Drawings that reflect this restriction. (d) At Final Plat stage, the Town's transportation engineering consultant shall verify the Applicant's Final Traffic Impact Study's methodology, assumptions, results, and recommendations. (e) Any required changes to the design and construction of the development's proposed transportation network to ensure there is adequate and sufficient transportation capacity as recommended by the Traffic Impact Study shall be included in the subdivision development agreement with the Applicant. (f) The Final Plat shall show a street width of 60 feet for the access road adjacent to Frontier Street and between lots 9 and 21. Section 4. Unless otherwise extended by the Board of Trustees, the approval of the Frontier Estates Filing No. 2 Preliminary Plat shall be null and void if a final plat for all or a portion A the property has not been submitted to the Town of Firestone within two (2) years of the date of this Resolution.
