HomeMy WebLinkAbout22-76 Approving Amended and Restated Barefoot Lakes Subdivision Filing No.5 06-08-2022RESOLUTION NO. 22-76 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO, APPROVING AN AME.?DED AND RESTATED SUBDIVISION AGREEMENT PERTAINI'` G TO THE BAREFOOT LAKES FILING NO.5 SUBDIVISION WHEREAS, the Town and Barefoot LLC ("Barefoot") entered uito That certaui Subdivision Agreement, dated November 16111, 2020(the "Original Agreement"), to set forth their respective rights and obligations with res�iect to the development of the Barefoot Lakes Filing No. 5 subdivision and the installation of certain public improvements required to serve the subdivision; an WHEREAS, the Panties to the Original Agreement wish to amend, modify, change and alter certain provisions of the Original Agreement to provide for: (a) removal of restrictions on the issuance of certificates of occupancy. WHEREAS, the Town Board wishes to authorize the execution of an "Amended and Restated Subdivision Agreement" with Barefoot to acconunodate the above changes. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO: Section 1. The Amended and Restated Subdivision Agreement pertaining to the Barefoot Lakes Filing No. 5 subdivision is approved in substantially the same form as the copy attached to this resolution, subject to and contingent upon satisfaction of all of the conditions set forth in Section 2. The Mayor is authorized to execute the agreement on behalf of the Town. Section 2. Within �0 days of the date of this resolution, Barefoot shall deliver to the Town a Joinder, Ratification and Adoption of Amended and Restated Subdivision Agreement, in a form substantially similar to the copy attached to this resolution, duly completed and executed by Lemur Colorado LLC.
