HomeMy WebLinkAbout1017 Application to Amend Firelight Park Outline Development Plan 07-13-2022ORDINANCE NO. 1017 AN ORDINA1110E OF THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO APPROVING AN APPLICATION TO AMEND THE FIRELIGHT PARK OUTLINE DEVELOPMENT PLAN WHEREAS, Voyage Venhues LLC (the "Applicant"), as owner of certain real property located within Firelight Park (the "Property"), has submitted an application to amend the existing Firelight Park Outline Development Plan, to be known as Firelight Park Outline Development Plan Amendment No. 1 (the "Application")*, and WHEREAS, the Firestone Plaiminng and Zoning Conunission, after conducting a public hearing on the proposed Application on June 16, 2022, rendered a decision reconunending approval of the Application with one (1) condition as more fully set forth in PC-22-09, dated June 16, 2022, and WHEREAS, on June 16, 2022, the Board of Trustees conducted a public hearing on the Application; and WHEREAS, after reviewing the record of the Plauuiing and Zoning Commission public hearing, and aver considering the testimony, evidence and argument presented at the Board of Trustees public hearing, the Board of Trustees finds and determines that the proposed Application is in substantial conformance with the technical requirements of the Firestone Development Code, and that the proposed development plan meets the applicable requirements and standards set forth in the Firestone Municipal Code and Firestone Development Code, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO: Section 1. The Board of Trustees acknowledges the Planning and Zoning Conmussionn's findings of fact in this case, as detailed in Resolution PC-22-09. Section 2. The above Recitals and Findings of the Board of Trustees are Hereby incorporated into this ordinance. Section 3. The Board of Trustees hereby approves the Firelight Park Outline Development Plan Amendment No. 1, attached hereto as Exhibit A and incorporated herein by this reference, which is subject to: 1. All remaining technical corrections to the Firelight Park Amended Outline Development Plan requested by Town staff shall be made to the Town staff s satisfaction. Section 4. The Board of Trustees directs that a certified copy of this Ordinance be filed with the Town Clerk and fiurther, that the Town Clerk index, file and make the Ordinance available to the public. Section 5. If any article, section, paragraph, sentence, clause or phrase of this ordinance is held to be unconstitutional or invalid for any reason, such decision will not affect the validity or constitutionality of the remaining portions of this ordinance. The Board of Trustees hereby declares that it would have passed this ordinance and each part or parts hereof irrespective of the fact that any one part or parts be declared unconstitutional or invalid. Section G. All other ordinances or portions thereof inconsistent or conflicting with this ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict.
