A RESOLUTION OF THE BOARD OF TRUSTEES OF THE TOWN OF
FIRESTONE, COLORADO, APPROVING A PRELIMINARY
SUBDIVISION PLAT FOR CERTAIN REAL PROPERTY LOCATED
WITHIN THE VISTOSA SUBDIVISION
WHEREAS, Prominence Partners I LLC ("Applicant"), as owner of certain real property
located within the Vistosa subdivision (the "Property"), has submitted a proposed preliminary
subdivision plat ("Preliminary Plat") for the Property; and
WHEREAS, the Firestone Planning and Zoning Commission, after conducting a public
hearing on the proposed preliminary subdivision plat on July 7, 2022, rendered a decision
recommending approval of the Preliminary Plat with two (2) conditions as more fully set forth in
PC-22-13, dated July 7, 2022; and
WHEREAS, the Director of Planning & Development, in accordance with Section 16.7.7
"Minor Modifications" of the Firestone Development Code, has granted a Minor Modification for
Single -Family Detached -Al ley lots in the Property whereby reducing minimum lot area for said
lots from 3,500 square feet to 3,325 square feet; and
WHEREAS, on July 27, 2022, August 10, 2022, and August 24, 2022, the Board of
Trustee conducted a public hearing on the proposed Preliminary Plat; and
WHEREAS, after reviewing the record of the Planning and Zoning Commission public
hearing, and after considering the testimony, evidence and argument presented at the Board of
Trustees public hearing, the Board of Trustees finds and determines that the proposed Preliminary
Plat is in substantial conformance with the technical requirements of the Firestone Development
Code and applicable Minor Modification, and that the proposed development plan meets the
applicable requirements and standards set forth in the Firestone Municipal Code and Firestone
Development Code.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF
THE TOWN OF FIRESTONE, COLORADO:
Section 1. The Board of Trustees acknowledges the Planning and Zoning Commission's
findings of fact in this case, as detailed in Resolution PC-22-13.
Section 2. The Board of Trustees acknowledges the Director of Planning & Development
has approved a Minor Modification for the Property as detailed in the approval letter dated August 8,
2022.
Section 3. The above Recitals and Findings of the Board of Trustees are hereby
incorporated into this resolution.
Section 4. The Board of Trustees hereby approves the Preliminary Plat of Vistosa,
attached hereto as Exhibit A and incorporated herein by this reference, subject to compliance with
the following conditions:
(a) All remaining technical corrections to the Vistosa Preliminary Plat and
Construction Drawings requested by Town staff shall be made to the Town staffs
satisfaction.
(b) At the Final Plat stage, the Town and the Applicant shall execute a subdivision
agreement, in a form to be approved by the Town Attorney.
Section 4. Unless otherwise extended by the Board of Trustees, the approval of the
Vistosa Preliminary Plat shall be null and void if a final plat for all or a portion of the property is
not approved by the Town of Firestone within three years of the date of this Resolution.
