HomeMy WebLinkAbout22-121 Special Review Use Application Operate Senior Facility on 151 Grant Ave 11-09-2022RESOLUTION NO.22-121 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE COLORADO, APPROVING WITH CONDITIONS A SPECIAL REVIEW USE APPLICATION TO OPERATE A SENIOR FACILITY ON REAL PROPERTY LOCATED AT 151 GRANT AVENUE, WITHIN THE TOWN OF FIRESTONE WHEREAS, Carbon Valley Parks and Recreation District ("Applicant"), with authorization from the Town of Firestone, as owner of certain real property cominonly known as 151 Grant Avenue and located within the Town of Firestone, Colorado (the "Property"), has submitted an application for special review use approval for the Property to operate a senior community center (the "Application"); and WHEREAS, the Firestone Planning and Zoning Commission, at its meeting on November 3, 2022, reviewed the Application and considered the approval criteria set out in Section 16.7.11 of the Firestone Development Code during a public hearing, and rendered a decision recommending approval of the Application with two conditions, as more fully set forth in Resolution No. PC-22-14, dated November 3, 2022; and WHEREAS, after reviewing the Planning and Zoning Commission's recommendation, and after considering all the testimony, evidence, and argument presented at the public hearing held before the Board of Trustees on November 9, 2022, the Board of Trustees finds and determines that the Application is complete, and that the Applicant has met the special use review criteria set forth in Step 9, Section 16.7.1 LC of the Firestone Development Code. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF FIRESTONE, COLORADO THAT: Section 1. The Board of Trustees acknowledges the Planning and Zoning Commission's findings of fact in this case, as detailed in Resolution PC-22-14: Section 2. The above Recitals and Findings of the Board of Trustees are hereby incorporated into this resolution. Section 3. Carbon Valley Parks and Recreation District's application for a special use review to construct and operate a senior community center on the Property as a special use is hereby approved, subject to and contingent upon compliance with the following conditions: a. The special review use approval shall only apply to that portion of the Property upon which the former Town Hall and associated parking lot is situated. b. Prior to the issuance of a building permit for the construction of the senior center, applicant shall prepare a complete and accurate legal description and illustration of the leased premises at 151 Grant Avenue.
