A RESOLUTION OF THE BOARD OF TRUSTEES OF THE TOWN OF
FIRESTONE, COLORADO, ACCEPTING THE DEDICATION OF A
BUILDING SETBACK, UTILITY AND DRAINAGE EASEMENT FROM
COLLECTIVE LAND HOLDING PARTNERSHIP, LLC AND VACATING A
PORTION OF THE EXISTING BUILDING SETBACK, DRAINAGE AND
UTILITY EASEMENT PERTAINING TO LOT 1-B-1 OF THE DEL CAMINO
JUNCTION BUSINESS PARK P.U.D.
WHEREAS, Collective Land Holding Partnership, LLC ("Owner") is the owner of certain
real property located in the Town of Firestone ("Town"), legally described as Lot 1-B-1, Del Camino
Junction Business Park P.U.D., 2nd Amendment (the "Property"); and
WHEREAS, Owner intends to develop flex space building with light industrial uses on the
Property ("Project") pursuant to a Non -Residential Minor Plat Amendment ("Plat") and Final
Development Plan approved by the Town's Director of Planning and Development in accordance
with Sections 16.7.6.E and 16.7.10 of the Firestone Development Code; and
WHEREAS, the location of certain portions of the existing building setback, utility and
drainage easement within Lot 1-B-1 will conflict with the location of the proposed Project shown
on the Final Development Plan for the Property; and
WHEREAS, Owner proposes that a new building setback, utility and drainage easement
as depicted on the Plat, be dedicated to the Town to correspond with the location of the proposed
building and utility and drainage facilities for Lot 1-B-1 as shown on the Final Development Plan;
and
WHEREAS, the Board of Trustees finds and determines that the building setback, utility
and drainage easement on the Property is no longer necessary for the public use and convenience,
that the proposed new building setback, utility and drainage easement will be an acceptable way
to accomplish the same public purposes as are served by the existing easement, and the proposed
new building setback, utility and drainage easement will facilitate development of the Project.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF
THE TOWN OF FIRESTONE, COLORADO:
1. A portion of that certain building setback, utility and drainage easement within Lot
1-B-1, Del Camino Junction Business Park P.U.D., 2nd Amendment, as depicted on Exhibit A,
shall be vacated.
2. The dedication of a building setback, utility and drainage easement over, across, and
under certain portions of Lot 1-B-1, Del Camino Junction Business Park P.U.D., 2nd Amendment,
as such easement is described and depicted on the Plat, attached hereto, is accepted by the Board
of Trustees of the Town of Firestone, and the Mayor is authorized to execute the Plat on behalf of
the Town.
