AN ORDINANCE OF THE BOARD OF TRUSTEES OF THE TOWN OF
FIRESTONE, COLORADO APPROVING AN APPLICATION TO AMEND THE
COTTONWOOD HOLLOW OUTLINE DEVELOPMENT PLAN
WHEREAS, Cottonwood Colorado Residential, LLC and Cottonwood Residential V, LLC,
("Applicants"), as owners of certain real property located within the Town of Firestone, Colorado (the
"Property"), have submitted an application to amend the existing Cottonwood Hollow Subdivision
Outline Development Plan, to be known as the Cottonwood Hollow Outline Development Plan
Amendment No. 4 (the "ODP Amendment"), to accommodate adjustments to parcel size and allowable
density adjustments to block 2 of the Cottonwood Hollow Filing No. 4 subdivision (the "Application");
and
WHEREAS, the Firestone Planning and Zoning Commission, after conducting a public hearing
on the proposed Application on March 16, 2023, rendered a decision recommending approval of the
Application with one (1) condition as more fully set forth in PC-23-03, dated March 16, 2023; and
WHEREAS, on March 22, 2023, the Board of Trustees conducted a public hearing on the
Application; and
WHEREAS, after reviewing the decision of the Planning and Zoning Commission, and after
considering the testimony, evidence and argument presented at the Board of Trustees public hearing, the
Board of Trustees finds and determines that the proposed Application is in substantial conformance with
the technical requirements of the Firestone Development Code, and that the proposed development plan
meets the applicable requirements and standards set forth in the Firestone Municipal Code and Firestone
Development Code.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
TOWN OF FIRESTONE, COLORADO:
Section 1. The Board of Trustees acknowledges the Planning and Zoning Commission's
findings of fact in this case, as detailed in Resolution PC-23-03.
Section 2. The above Recitals and Findings of the Board of Trustees are hereby incorporated
into this ordinance.
Section 3. The Board of Trustees hereby approves the Cottonwood Hollow Outline
Development Plan Amendment No. 4, attached hereto as Exhibit A and incorporated herein by this
reference, which is subject to:
1. All remaining technical corrections to the Cottonwood Hollow Amended Outline
Development Plan requested by Town staff shall be made to the Town staff's satisfaction.
Section 4. The Board of Trustees directs that a certified copy of this Ordinance be filed
with the Town Clerk and further, that the Town Clerk index, file and make the Ordinance available to
the public.
Section 5. If any article, section, paragraph, sentence, clause or phrase of this ordinance is
held to be unconstitutional or invalid for any reason, such decision will not affect the validity or
constitutionality of the remaining portions of this ordinance. The Board of Trustees hereby declares that
it would have passed this ordinance and each part or parts hereof irrespective of the fact that any one
part or parts be declared unconstitutional or invalid.
Section 6. All other ordinances or portions thereof inconsistent or conflicting with this
ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict.
